トゥクトゥク観光サービス利用規約
本規約は、合同会社サクセライズ（以下「当社」といいます）が提供するトゥクトゥク観光サービス（以下「本サービス」といいます）をご利用いただくにあたり、適用されます。本サービスを予約・利用される方（以下「利用者」）は、以下の内容に同意いただいたものとみなします。
第1条（サービス内容）
1. 本サービスは、利用者が当社よりトゥクトゥク車両をレンタルし、当社が派遣するガイド兼運転手（業務委託スタッフ）による観光案内を受ける観光体験サービスです。
2. 運転は当社が業務委託したガイドが行い、利用者は車両の「借受人」となります。
第2条（予約および契約の成立）
1. 本サービスは、当社指定のWEBサイトからの事前予約制です。
2. 利用者は予約時に本利用規約に同意いただく必要があります。
3. 契約は、予約完了と同時に成立し、車両のレンタル契約およびガイド派遣サービスが含まれます。
第3条（保険および補償）
1. 当社は、トゥクトゥク車両に対し、自動車保険（対人・対物）および傷害保険に加入しています。
2. 万が一の事故等については、加入保険の範囲内で対応いたします。
3. 利用者の故意または重大な過失による損害は、保険適用外となる場合があります。
第4条（禁止事項）
以下の行為は禁止されます。
• ガイドの指示に従わない行為
• 車両の破損・改造・操作等
• 危険物の持ち込み
• 飲酒または薬物の影響下での利用
• 公序良俗に反する行為
第5条（キャンセルポリシー）
1. 利用者都合のキャンセルについては、以下のキャンセル料が発生します。
• 3日前まで：無料
• 前日：50%
• 当日・無連絡：100%
2. 天候不良等により当社が運行中止を判断した場合、全額返金いたします。
第6条（免責事項）
1. 天候、交通状況、第三者による妨害等によりサービスが変更・中止される場合があります。
2. 上記によって発生した損害について、当社は責任を負いかねます。
第7条（準拠法・管轄）
本規約は日本法に準拠し、利用者と当社の間で生じる一切の紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
Terms and Conditions for Tuk-Tuk Sightseeing Service
These Terms and Conditions apply to the Tuk-Tuk sightseeing service (hereinafter “the Service”) provided by Succeedrise LLC (hereinafter “the Company”). By making a reservation and using the Service, the customer (hereinafter “the Customer”) agrees to the following terms.
Article 1 – Service Overview
1. The Service consists of renting a Tuk-Tuk vehicle to the Customer, operated by a guide-driver dispatched by the Company (outsourced contractor), who provides basic sightseeing guidance.
2. The Customer is the legal lessee of the vehicle; driving is conducted solely by the guide-driver provided by the Company.
Article 2 – Reservations and Agreement
1. Reservations must be made in advance through the Company’s designated website.
2. The Customer must agree to these Terms and Conditions at the time of booking.
3. The contract is considered concluded upon confirmation of the reservation and includes both the vehicle rental and guide-dispatch services.
Article 3 – Insurance and Liability
1. The Company holds valid automobile insurance (liability and property) and accident insurance for the Tuk-Tuk vehicles.
2. In the event of an accident, compensation will be provided within the scope of the insurance coverage.
3. Damages caused by intentional acts or gross negligence by the Customer may not be covered by insurance.
Article 4 – Prohibited Conduct
The following actions are strictly prohibited:
• Failing to follow the guide-driver’s instructions
• Damaging, tampering with, or attempting to operate the vehicle
• Bringing hazardous or prohibited items on board
• Using the Service under the influence of alcohol or drugs
• Engaging in behavior that is offensive or violates public order and morals
Article 5 – Cancellation Policy
1. Cancellations made by the Customer are subject to the following fees:
• 3 days or more before the reservation date: Free
• 1 day before the reservation date: 50%
• Same day or no-show: 100%
2. If the Company cancels the Service due to weather or other unavoidable circumstances, a full refund will be provided.
Article 6 – Disclaimer
1. The Company may alter or cancel the Service due to weather, traffic, or other unforeseen events.
2. The Company bears no responsibility for any loss or damage caused by such changes or cancellations.
Article 7 – Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Japan. Any disputes arising between the Customer and the Company shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
